VeriDash Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VeriDash service (the "Service") provided by MIKS&T, INC. (Delaware C-Corporation, "we", "us", or "Company"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Definitions

  • "Service" means the VeriDash mobile application (Android/iOS) and related cloud features, including video recording, cloud storage, integrity hash chain generation, playback, sharing, and post-processing (such as face mosaic).
  • "User" means an individual who has registered an account and agreed to these Terms.
  • "Content" means all videos, metadata (GPS, timestamps, impact data), and processed derivatives (mosaic copies, etc.) generated through the Service.
  • "Integrity Verification" means the SHA-256 hash-chain feature that technically attests that a video file has not been modified within our system. It does not by itself guarantee evidentiary admissibility in any court or jurisdiction.

2. Eligibility

You must be at least 14 years old (with parental consent where required) to use the Service. By using the Service, you represent that you meet these requirements.

3. Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. We are not liable for losses arising from your failure to safeguard your credentials.

4. Service and Modifications

We provide the Service "as-is" and may modify, suspend, or discontinue any part of the Service with reasonable prior notice (at least 30 days for material changes), except when an immediate change is required to comply with law, security, or operational necessity.

5. Subscription and Billing

  • Free Trial: New users may receive a free trial (currently 7 days). After the trial, paid features become subject to a recurring subscription.
  • Payment: Payments are processed by Stripe, Inc. under a PCI-DSS-compliant environment. We do not store your card details on our servers.
  • Auto-Renewal: Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date through the billing portal.
  • Refunds: You may request a full refund within 7 days of purchase if you have not materially used the Service (0 video uploads). Otherwise, refunds follow applicable consumer-protection law in your jurisdiction.

6. User Conduct

You agree not to:

  • Upload Content recorded unlawfully or in violation of third parties' privacy, dignity, or other rights.
  • Use the Service in a way that infringes copyright, defames, or harasses any person.
  • Attempt to circumvent or forge the Integrity Verification.
  • Run automated bots, crawlers, or excessive-load scripts against the Service.

You are solely responsible for the Content you record and upload, including obtaining any necessary consent from third parties appearing in the video. We strongly encourage you to use the face mosaic feature (Section 7) before sharing footage publicly or submitting it as evidence.

7. Face Mosaic Processing and Integrity of Derivatives

The Service offers an opt-in face mosaic feature (Beta) that automatically detects faces in your video and lets you select which faces to mosaic. Processed copies have a different SHA-256 hash and are therefore excluded from the original video's integrity chain. You may choose:

  • Keep original + add mosaiced copy (recommended): the original remains intact, with the mosaiced version stored as a separate clip.
  • Replace original: the original is deleted from cloud storage and replaced by the mosaiced version. The integrity chain of the original is permanently lost in this case and cannot be restored.

By choosing "Replace original," you acknowledge and accept this consequence.

8. Content Ownership and License

You retain all ownership of your Content. You grant us a non-exclusive, royalty-free, worldwide license to store, transmit, process, and display the Content solely as needed to operate the Service for you. This license terminates when you delete the Content or terminate your account.

We will not use your Content for marketing, advertising, or third-party purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE INTEGRITY VERIFICATION WILL BE ACCEPTED AS EVIDENCE BY ANY COURT OR AUTHORITY.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, EXCEPT IN CASES OF OUR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE.

11. Legal-Evidence Use

The Integrity Verification is a technical tool that demonstrates the video file has not been altered within our system. It does not guarantee that any court, tribunal, or authority will admit the video as evidence. If you intend to submit footage as legal evidence, we strongly recommend consulting an attorney in advance.

We may disclose Content or metadata to law enforcement when:

  • Required by a valid court order or warrant
  • Compelled by lawful government request
  • You have given explicit consent

When permitted by law, we will give you advance or prompt subsequent notice.

12. Suspension and Termination

We may suspend or terminate your account upon reasonable notice (or immediately in urgent cases) if you breach these Terms, your subscription has been past-due for more than 30 days, or law enforcement has issued a valid request.

13. Account Deletion

You may close your account at any time from Settings → Account. All your videos will be permanently deleted from cloud storage upon account closure. Please download any videos you wish to retain before deleting your account. Metadata required to be retained by law may be kept for the legally required period.

14. Privacy

Your personal information is processed in accordance with our [Privacy Policy](/legal/privacy).

15. Governing Law and Jurisdiction

  • For users residing in South Korea, these Terms are governed by Korean law and disputes shall be resolved by the Seoul Central District Court as the court of first instance.
  • For users residing elsewhere, these Terms are governed by the laws of the State of Delaware, USA, and disputes shall be resolved by the Delaware Court of Chancery. EU/UK residents retain the mandatory protections of their local law.

16. Dispute Resolution

Before initiating litigation, you agree to first contact our support team at johnnie@miksnt.com in writing. We will respond within 30 days. If we cannot resolve the dispute amicably, either party may pursue available legal remedies under Section 15.

Effective Date: This v2 of the Terms is effective from June 12, 2026.

  • Users who registered before this date will be presented with an explicit re-consent screen on next login.
  • The Korean-language version is the authoritative original; English, Japanese, and Spanish versions are provided for reference. In case of inconsistency between languages, the Korean version prevails.
